Egypt follows a first to file system. Anyone who files the trademark registration first and gets accepted becomes the trademark owner. To file an application, the applicant must file with Egypt Trademarks Office. Multiple classes can be filed in a single application but it is not recommended to do so because if there is a delay in one class, it will result in delays in all the classes and thus the overall application procedure will be delayed.

Application

The application must contain the following details:

  • The name and address of the applicant;
  • The details of the trademarks;
  • Class(es) under which the goods and services are going to be used;
  • Priority document (if it is to be claimed).
  • A power of attorney is necessary for foreign applicants.

The application fee must also be paid.

Examination

If the application is approved, it is then checked and examined on absolute and relative grounds. The application is checked if it is complete and if the application has any discrepancies. If everything is in order, then the application is checked for registration, if the trademark can be registered in the first place or if there already are similar or identical trademarks present. The classification of goods and services is also checked. 

Based on the examination, the application is rejected or accepted.

Publication

To publish the trademark in the official gazette, the publishing fee has to be paid first. Once the fee is paid, the trademark is published for 60 days.

Opposition

During the 60 days of publication, interested parties are allowed to oppose the application by providing evidence and proper argument. If there is an opposition filed, the Trademarks Office reviews both the arguments and takes the decision based on these arguments.

Registration

If there is no opposition or if the decision is in favour of the applicant, the trademark gets registered and a Certificate of Registration is issued.

How long does the trademark last?

Trademark in Egypt lasts for 10 years, after which it can be renewed. The owner can renew the trademark within 6 months from expiration or 6 months after the expiration. If it is the latter, then an additional fee has to be paid.
